Terms and Conditions (T&Cs)
Villa Barka, Eppenschlag
§ 1 Scope
These Terms and Conditions apply to contracts for the letting of the holiday apartment *Villa Barka* in Eppenschlag and all related services (e.g. cleaning, additional services). Any deviating or supplementary agreements must be made in writing.
§ 2 Booking and Conclusion of Contract
The tenancy agreement becomes binding upon confirmation of the booking by the landlord. Bookings may be made by email, telephone or via an online platform. By confirming the booking, the guest accepts these GTC.
§ 3 Prices and Terms of Payment
Prices start from €110.00 per night; there is no cleaning fee.
The accommodation is approved for a maximum of two guests plus a maximum of one child under the age of 2, who sleeps in their parents’ bed or for whom the guest brings their own cot.
Payment of the total amount must be made no later than 28 days before the start of the stay. For last-minute bookings, the amount is due immediately.
Charging an electric vehicle is charged at €0.40 per kWh.
§ 4 Visitor’s tax
There is currently no visitor’s tax in Eppenschlag. Tourist taxes are borne by the host.
§ 5 Cancellation
Cancellation is free of charge up to 28 days before arrival. From the 27th day before the start of the stay, or in the event of a no-show, the full booking price (100%) is due. We recommend taking out travel cancellation insurance.
Different terms and conditions may apply to certain special rates or promotional prices. In certain cases – such as with non-refundable rates on Booking.com – no free cancellation or refund is possible. The terms and conditions stated at the time of booking apply.
§ 6 Arrival and departure
Check-in is possible between 2 pm and midnight. Check-out must take place by 12 noon at the latest. Access to the holiday flat is via an electronic code lock on the patio door. The individual access code will be sent to the guest electronically in good time before arrival.
§ 7 Use of the holiday flat
The flat may only be used by the guests for whom the booking has been made. Smoking is prohibited in the flat. Unfortunately, pets are not permitted. In the event of serious breaches (e.g. noise disturbance, overcrowding, damage), the landlord reserves the right to terminate the tenancy agreement with immediate effect.
§ 8 Additional services and on-site payments
Additional services available at the holiday apartment, e.g. the purchase of local wine or the hire of snowshoes, a barbecue, a pizza oven, etc., may be used on site and must be paid for in cash or by credit card at the latest upon check-out. The applicable prices are listed in the guest information folder.
§ 9 Liability
The guest undertakes to treat the accommodation and its contents with care. The guest is liable for any damage caused by them or their fellow travellers during their stay. The landlord accepts no liability for the guest’s valuables and is liable only in cases of wilful misconduct or gross negligence.
§ 10 Data Protection
Personal data is processed exclusively for the purpose of contract fulfilment and in accordance with the applicable data protection regulations (GDPR, Bavarian Data Protection Act) and will not be passed on to third parties.
§ 11 Exclusion of Right of Withdrawal pursuant to Section § 312g Abs. 2 Nr. 9 of the German Civil Code (BGB)
There is no statutory right of withdrawal for contracts concerning the short-term letting of accommodation for lodging purposes if the contract has been concluded for a specific period. This excludes withdrawal without cancellation conditions following booking confirmation. Only the cancellation provisions set out in these General Terms and Conditions apply.
§ 12 Final Provisions
Should any provision of these General Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected. The place of performance and jurisdiction is the landlord’s place of residence in Eppenschlag, Bavaria.
